In order to use, access or register with Macclesfield Forum, you must agree to the following Terms of Use:

  1. Definition & Agreement to be Bound

Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that Macclesfield Forum has the right to remove, edit, move or close any topic at any time should we see fit.

You agree not to publish, post, upload or otherwise make available on the Forum any material protected by copyright, trademark or other proprietary right [except in a clearly "fair use" capacity] without the express permission of the owner of the copyright, trademark or other proprietary right. You agree that you are responsible for determining that any material is not protected by copyright. You shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. You further agree to indemnify Macclesfield Forum from any liability [including reasonable attorney fees] related to any violation by you of copyright law in this respect.

  6. Rights Granted

You hereby grant Macclesfield Forum a non-exclusive, perpetual, irrevocable, royalty-free, right, licence and privilege worldwide [hereinafter "Rights"], to any and all text, posts, private messages, comments and any other original content that you post or cause to be posted within the Forum [hereinafter "Materials"].
    2. You further grant Macclesfield Forum similar Rights to incorporate the Materials into the Forum and to archive, publish or otherwise utilize the Materials within the Forum, and to publicly display the Materials within the Forum.
  7. Rights Waived

    1. You hereby warrant and represent that you are aware of your rights in the United Kingdom and other countries, to claim authorship rights in respect to the Materials, in which copyright subsists and your moral rights relating thereto.
    2. In the event that your membership, user account or other association with Macclesfield Forum is deactivated or terminated, by either yourself or by Macclesfield Forum, for any reason whatsoever, you hereby permanently and irrevocably waive all moral rights that you may have under the laws of any country in and to the Materials. This waiver is made in favor of Macclesfield Forum, who may hereinafter use, modify or do anything to or with the Materials referenced above that would or might, but for this waiver, constitute a breach of your moral rights anywhere worldwide.

You shall indemnify and hold harmless Macclesfield Forum from and against any and all claims, damages, liabilities, costs and expenses [including reasonable attorney fee], arising out of or in any way connected with any breach of any representation or warranty made by you herein.
  9. Disclaimer

    1. The Forum is provided on an "AS IS" basis, without warranty of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of fitness for a particular purpose or merchantability, non-infringement, accuracy and security. Macclesfield Forum, its successors and assigns, owners, officers, administrators, moderators, directors, agents and / or employees [hereinafter "Macclesfield Forum", "we", "us" and "our"] does not warrant that the functionality of the Forum will be uninterrupted or error free, that defects will be corrected, or that it is free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials.
  10. Limitation of Damages

    1. Under no circumstances, including negligence, shall Macclesfield Forum be liable for any direct, indirect, incidental, special, punitive or consequential damages that may result from the use or inability to use the Forum including without limitation use of or reliance on information available through the Forum, interruptions, errors, defects, mistakes, omissions, deletions of files, delays in operation or transmission, nondelivery of information, disclosure of communications, or any other failure of performance.
  11. Release and Indemnity

    1. You hereby release and waive any and all claims and/or liability against Macclesfield Forum arising from or in connection with your use of the Forum. You also agree to defend, indemnify and hold harmless, Macclesfield Forum from and against, any and all claims or liability, including costs and attorneys fees, arising from or in connection with your use of the Forum or failure to abide by applicable law.
  12. Scope and Changes

    1. This Agreement is binding upon and shall inure to the benefit of the respective successors and/or assigns of the parties hereto. It sets forth the entire Agreement and understanding between you and Macclesfield Forum, with respect to the subject matter hereof.
    2. This Agreement [including the Forum Rules] may be changed by us at any time and without notice; while we will take reasonable measures to promptly informing you of such changes, you hereby agree that it is your responsibility to review this Agreement regularly yourself. You also agree that continued usage of Macclesfield Forum after any such changes, indicates that you agree to be legally bound by the Agreement, after it is updated and/or amended.
  13. General Provisions

    1. The failure by Macclesfield Forum to require performance of any provision of the Agreement shall not affect our right to require performance at any time thereafter, nor shall a waiver of any breach or default of the Agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
    2. If any provision herein is held unenforceable, then such provision will be modified to reflect the intention of Macclesfield Forum, and the remaining provisions of the Agreement will remain in full force and effect.
    3. The section titles in the Agreement are for convenience only and have no legal or contractual effect.
    4. Disputes arising from the Agreement shall be exclusively subject to the laws of a jurisdiction chosen by Macclesfield Forum.
